Service Process Fee Increase

As you may have heard the service process fee as outlined in IC 33-37-5-15 will be increasing from $25 to $28 as of July 1st. $1 of that increase will be set aside to go to the clerk’s record perpetuation fund.

 

For those of you that assess the process fee, this means that any mention of a $25 process fee in the letters will need to be corrected. I plan to change this to say just that a service process fee will be assessed, but without naming the specific amount. However, you may want to review your letters as well.

 

As of 7/1, all existing warrants without any payment history will have their fees updated in ATWS. This means that taxpayers coming to the office after then may have received a letter stating a $25 fee but they will be charged $28. You may want to print a sign indicating the date of the Indiana Code change.

 

For the $1 clerk’s record perpetuation fund fee, you will need to count the number of $28 fees that were collected and write a separate check for that number – e.g., if you took in 50 payments of $28, you would write a check for $50.00 to account for the $1 fee on each. We are looking at a way to automate processing the fee and will update you as soon as we have more information.
